Under current law and practice, the Fund is not liable to any Luxembourg income tax, nor are dividends paid by the Fund liable to any Luxembourg withholding tax. However, the Fund is liable in Luxembourg to an annual tax of 0.05 per cent, calculated and payable quarterly, on the aggregate Net Asset Value of the outstanding Units of the Fund at the end of each quarter. This annual tax is however reduced to 0.01 per cent on the aggregate Net Asset Value of the Units in the Classes reserved to institutional investors as well as in Sub-Funds that invest exclusively in certain short-term transferable debt securities and other instruments pursuant to the Grand-Ducal Regulation of 14 April 2004.
This rate is reduced to 0% for the portion of the assets of the Fund invested in other Luxembourg undertakings for collective investment already submitted to an annual tax. No stamp duty or other tax is payable in Luxembourg on the issue of Units in the Fund.
No tax is payable in Luxembourg on realised or unrealised capital appreciation of the assets of the Fund. Although the Fund's realised capital gains, whether short- or long-term, are not expected to become taxable in another country, Unitholders must be aware and recognise that such a possibility, though quite remote, is not totally excluded.
Taxation of Unitholders
Under current legislation, Unitholders are not subject to any capital gains, income, withholding or inheritance taxes in Luxembourg except for (i) those domiciled, resident or having a permanent establishment in Luxembourg, (ii) non-residents of Luxembourg who hold more than 10% of the capital of the Fund and who dispose of all or part of their holdings within 6 months from the date of acquisition or (iii) in some limited cases, some former residents of Luxembourg who hold more than 10% of the capital of the Fund.
The Council of the European Union has adopted Council Directive 2003/48/EC regarding the taxation of savings income in the form of interest payments (“the Directive”). The Directive entered into force on 1 July 2005. The Directive provides that certain interest payments and investment fund distributions/redemptions made by a paying agent (within the meaning of the Directive) situated within a European Union member state, within an associated or dependent territory or a third country (as defined in the Directive) to an individual or certain entities (residual entities within the meaning of the Directive) resident in another EU member state or associated or dependant territory will either have to be reported by the paying agent to the tax authorities of his country of establishment or will be subject to a withholding tax depending on the location of the paying agent. The applicable regime will depend on the paying agent’s country of residence.

Conform legislaţiei în vigoare, deţinătorii de unităţi de fond nu sunt supuşi în Luxemburg impozitării pe câştigurile de capital, venit, impozitării cu reţinere la sursă sau pe moştenire, cu excepţia (1) celor care îşi au domiciliul, reşedinţa sau care au un sediu permanent în Luxemburg, (2) nerezidenţilor în Luxemburg care deţin mai mult de 10% din capitalul fondului şi care îşi înstrăinează total sau parţial unităţile deţinute în termen de 6 luni de la data achiziţiei sau (3) în anumite cazuri specifice, unor foşti rezidenţi în Luxemburg care deţin mai mult de 10% din capitalul fondului.
Consiliul Uniunii Europene a adoptat Directiva Consiliului 2003/48/CE privind impozitarea veniturilor din economii sub forma plăţilor de dobânzi (denumită în cele ce urmează "Directiva"). Directiva a intrat în vigoare la data de 1 iulie 2005. Directiva prevede că anumite plăţi de dobânzi şi distribuiri/răscumpărări aferente fondurilor de investiţii, efectuate de către un agent plătitor (în sensul Directivei) dintr-un stat membru al Uniunii Europene, în cadrul unui teritoriu asociat sau dependent al unei terţe ţări (aşa cum este definit în Directivă) către o persoană sau anumite entităţi (entităţi reziduale în sensul Directivei) rezidentă/e într-un alt stat membru al Uniunii Europene sau teritoriu asociat sau dependent vor trebui fie declarate de către agentul plătitor autorităţilor fiscale din ţara în care s-a stabilit, fie supuse unei impozitări cu reţinere la sursă, în funcţie de zona în care se află agentul plătitor. Regimul aplicabil depinde de ţara în care are reşedinţa agentul plătitor.

Text sursă - română Art. 1. - (1) Prezenta lege reglementează condiţiile minime de acces la activitatea de colectare pe cale amiabila a debitelor şi desfăşurarea acesteia pe teritoriul României, prin Agentiile de recuperare a debitelor, avand rolul de a sustine economia nationala prin imbunatatirea situatiei financiare a creditorilor, in conditiile existentei unui just echilibru intre protectia debitorilor, prin respectarea celor mai inalte standarde profesionale in domeniu si necesitatea asigurarii creditorilor a mijloacelor de colectare a debitelor inainte de etapa judiciara sau cea de executare silita.
Art. 2. - (1) Activitatea de colectare pe cale amiabila se desfăşoară cu titlu profesional prin agentiile de colectare a debitelor, prin avocati, precum şi prin departamentele interne specializate in colectarea amiabila a debitelor, apartinand societatilor comerciale, avand dreptul sa colecteze doar creantele proprii acelei societati, în condiţiile stabilite prin prezenta lege şi prin reglementările emise de Ministerul Economiei (nn. sau alta autoritate decisa de AMCC), Directia de Reglementare, Autorizare si Supraveghere a Agentiilor de Colectare a Debitelor în aplicarea prezentei legi.
(2) Este interzisă desfăşurarea cu titlu profesional a activităţii de colectare de debite de alte entitati sau persoane decât cele prevăzute la alin. (1).
Art. 3. - (1) Ministerul Economiei este singura autoritate în măsură să decidă dacă activitatea desfăşurată de o persoana sau entitate este de natura activităţii de colectare amiabila cu titlu profesional şi intră sub incidenţa prezentei legi.
(2) La încadrarea activităţilor de colectare pe cale amiabila în categoria celor desfăşurate cu titlu profesional, Ministerul Economiei va avea în vedere aspecte precum: desfăşurarea acestora ca activităţi economice de sine stătătoare, orientate spre obţinerea de venituri cu caracter regulat; existenţa unor structuri interne specializate în domeniul colectarii de debite pe cale amiabila care gestionează şi analizează aceste activităţi în mod distinct, pe baza unor reguli prestabilite şi cu luarea în considerare a activităţilor de colectare amiabila la proiectarea bugetului societăţii ori la efectuarea de previziuni referitoare la activitatea de ansamblu a societăţii.
Art. 4. - În exercitarea competenţelor sale prevăzute de lege, Ministerul Economiei poate prelucra orice date şi informaţii relevante, inclusiv de natura datelor cu caracter personal, în conformitate cu prevederile Legii nr. 677/2001 pentru protecţia persoanelor cu privire la prelucrarea datelor cu caracter personal şi libera circulaţie a acestor date, cu modificările şi completările ulterioare.
Traducere - engleză Article 1. - (1) This law establishes the minimum requirements for performing amicable debt collection activities and the legal framework for the amicable debt collection activities in Romania, performed by debt collection agencies, and its purpose is to support the national economy by improving the financial situation of the creditors, taking into consideration a fair balance between the protection of debtors, by meeting the highest professional standards in the field and the need to provide debt collection means for the creditors, before the judicial or enforcement stage.
Article 2. - (1) The amicable debt collection activity is professionally performed by debt collection agencies, lawyers, as well as internal departments specialized in amiable debt collection, belonging to companies and having the right to collect only the receivables of those companies, under the conditions regulated by this Law and the regulations issued by the Ministry of Economy (or any other authority designated by the Association for the Receivable Collections Management) with its Regulatory, Licensing and Debt Collection Agencies Supervision Division, concerning the enforcement of this law.
(2) Other entities or persons, excepting those referred to in paragraph (1) may not perform professionally debt collection activities.
Article 3. - (1) The Ministry of Economy is the sole authority to decide whether the activity performed by one person or entity is a professional amicable debt collection activity that may be regulated by this law.
(2) When categorizing the amicable debt collection activies as professionally performed activities, the Ministry of Economy will take into consideration issues such as: performing these activities as independent economic activities, for the purpose of obtaining income therefrom on a continuing basis, the existence of internal structures specialized in amicable debt collection that distinctly manage and analyze these activities, using predetermined rules and taking into account the amicable debt collection activities when creating the budget of the company or when making predictions about the overall activity of the company .
Article 4. - When exercising of its powers as provided by law, the Ministry of Economy may process all relevant data and information, including personal data, in accordance with the Law No. 677/2001 on the Protection of Individuals with Regard to the Processing of Personal Data and the Free Movement of Such Data, amended and completed.
