Law: Contract(s)
Loan Contract
Here is a clause from an Austrian loan contract:
"Die XXXX GmbH bestätigt, von
____________________________________________________________________ ein Darlehen in Höhe von CHF xy.000,-- zugezählt erhalten zu haben und anerkennt hiermit ausdrücklich, den Betrag in Höhe von CHF xy.000,-- aufrecht zu schulden."
Does "aufrecht' here mean "valid" in the Austrian sense: "confirms to have received a loan in the amount of... and expressly acknowledges to owe the valid amount of ...?"
Just want to make sure it's not "honestly owe" (or something like that, i.e. with an honest intention to pay it back.)
"Die XXXX GmbH bestätigt, von

to owe as a total current debt (with subsisting effect)
Tentatively - if the top-up + original loan equal the the 2nd figure**:
\"Die XXXX GmbH bestätigt, von
____________________________________________________________________ ein Darlehen in Höhe von CHF xy.000,-- zugezählt erhalten zu haben und anerkennt hiermit ausdrücklich, den Betrag in Höhe von CHF xy.000**,-- aufrecht zu schulden >
XXXX GmbH confirms to have received from ______ a 'topped'-up loan of CHF xy.000 and does hereby expressly acknowledge owing (on a consolidated, subsisting debt) the amount of CHF xy.000**.
AUT: für die Zeit des aufrechten Bestehens (Aufrechterhaltung) des Kreditverhältnisses = yes, validly for the continuance of the loan facility. Surely, nothing do with honesty - rather with 'subsistently'. or sustainably as a consolidated debt.

There are very few, and they mostly seem to be old.
You can't say "confirms to have received" and "acknowledges to owe". It's "confirms receipt" and "acknowledges owing", or something along those lines.
