intrsessiharkinta, intressipunninta Intressipunnintamallissa päätöksenteko pohjautuu sääntelyinformaation ohella keskenään erisuuntaisten intressien punnintaan (intressivertailu; huom. intressipunninta ei ole siis oikeuslähteiden tulkintaa)

Intressiharkinta takaa toimenpiteiden oikeasuhteisuuden.
Intressiharkinta on aina tapauskohtaista, minkä vuoksi oikeuskäytännöstä on vaikea löytää mitään siihen sovellettavia yleisiä periaatteita.

weighing the interests

This expression seems to be in use at least in EU legislation. It seems now to be translated as 'intressien punninta'. For me, both these newer (?) expressions ('weighing the interests', 'intressien punninta') appear more logical and expressive.
