Za tohoto stavu věci, kdy řízení o výmazu ochranné známky z rejstříku bylo zahájeno na návrh a namítatel nepředložil důkazy, z nichž by bylo možno seznat jím předestíraná tvrzení, že by ochranná známka měla být do rejstříku zapsána v rozporu s mezinárodními smlouvami, nese namítatel procesní odpovědnost za to, že úřad neměl možnost učinit zjištění, která by svědčila o oprávněnosti jeho návrhu.
