WHEREAS:
(A) Licensee wishes to use the Licensed Software for the purpose of developing and distributing Applications and/or Devices (each as defined below); and
(B) The XX Company is willing to grant the Licensee a right to use Licensed Software for such a purpose pursuant to term and conditions of this Agreement.
NOW, THEREFORE, THE PARTIES HEREBY AGREE AS FOLLOWS:
1. DEFINITIONS
“Affiliate” of a Party shall mean an entity (i) which is directly or indirectly controlling such Party; (ii) which is under the same direct or indirect ownership or control as such Party; or (iii) which is directly or indirectly owned or controlled by such Party. For these purposes, an entity shall be treated as being controlled by another if that other entity has fifty percent (50 %) or more of the votes in such entity, is able to direct its affairs and/or to control the composition of its board of directors or equivalent body.
“Add-on Products” shall mean The XX Company’s specific add-on software products, which are not licensed as part of The XX Company’s standard offering, but shall be included into the scope of Licensed Software only if so specifically agreed between the Parties.
“Applications” shall mean Licensee's software products created using the Licensed Software, which may include the Redistributables, or part thereof.
“Contractor(s)” shall mean third party consultants, distributors and contractors performing services to the Licensee under applicable contractual arrangement.
“Customer(s)” shall mean Licensee’s end users to whom Licensee, directly or indirectly, distributes copies of the Redistributables.
“Data Protection Legislation” shall mean the General Data Protection Regulation (EU 2016/679) (GDPR) and any national implementing laws, regulations and secondary legislation, as may be amended or updated from time to time, as well as any other data protection laws or regulations applicable in relevant territory.

Source text - English As a three-time judge of the Chen Bochui International Children's Literature Award, I have greatly enjoyed the chance to get to know our committee chairman Mr. Gao and all my fellow judges, and to learn what interests each of them the most about picture books and how they evaluate them. I have been struck by my Chinese colleagues' frequent choice of the word "philosophical" as a term of praise for the picture books they feel most strongly about. This is a good reminder, I think, that even the most lighthearted and playful story can have something serious to say about life and that young children are more than capable of rising to the challenge of thinking and dreaming in a philosophical way. After all, almost from the moment small children learn to talk, they are the ones who cannot stop asking such "big questions" as: "Why do people die?"; "Why doesn't the sky fall down?"; and "How did the world begin?"
From 2018, which was the first year I served as a judge, to 2021, I have noticed at least two significant changes in the Chinese books submitted for the award. The first change is a dramatic rise, overall, in the quality of the books. More often now, the illustrations are not only more technically accomplished than in the past but also more thoughtfully arranged to create a strong and consistent emotional and aesthetic impact.
The second change is a more highly developed understanding of the role that the central character or hero of a picture book can play as a unifying narrative element and as an emotional focal point for the reader. When a young child opens a picture book, it is as though he or she has opened the door to a strange, new world. In most picture books, it is the "job" of the main character to act as the child's guide to that world, and to become someone the child can identify with. It is thanks to the presence of this character that the child does not feel entirely alone in the strange, new world of the book, and can therefore begin to explore it more confidently and with a greater sense of purpose.
This year, I was also glad to see so many Chinese picture books with stories about aspects of everyday life in China and about traditional Chinese folkways and traditions of one kind or another. As it becomes more common for one country's authors and illustrators for children to publish their work for a global audience, it must be very tempting to create books that would not look too foreign to readers anywhere. But books that try too hard to be for everyone run the risk of being for no one at all. As James Joyce, who set his monumental novels in one tiny corner of the city of Dublin, said: "In the particular is contained the universal." Many Western readers are eager to know more about China and I think it will not be long before more Chinese picture books are published in the West.

First, “noumenon Tao”: Tao (The Way) that can be spoken of is not the Constant Tao; the name that can be named is not a Constant Name. As Zhang Dainian wrote, “The Tao is the first noumenon concept in classical Chinese philosophy. Laozi is the founder of the ontology in ancient Chinese philosophy.” In the beginning of Tao Te Ching, it reads, “Tao that can be spoken of is not the Constant Tao; the name that can be named is not a Constant Name. Nameless, is the origin of Heaven and Earth; the named is the Mother of all things. Thus, the constant void enables one to observe the true essence. The constant being enables one to see the outward manifestations. These two come paired from the same origin. But when the essence is manifested, it has a different name. This same origin is called ‘The Profound Mystery.’ It is the Gate to the essence of all life.” It reads in Heaven and Earth in The Zhuangzi that, “It is the Tao that overspreads and sustains all things. How great it is in its overflowing influence! The Superior man ought to by all means remove from his mind (all that is contrary to it). Acting without action is what is called Heaven. Humans are a part of nature, so they cannot break away from nature and exist independently. After the emergence of humans, it became “the named”. The state before the emergence of humans, called “the origin of Heaven and Earth”, was the natural state of nature. Mankind’s understanding of the formation of the objective world through language and thinking can be called “the named”. Corresponding to name and nameless, “the everlasting Tao acts according to the natural Way. Therefore, there is nothing that it will not accomplish.”
