Le PRENEUR devra utiliser les LOCAUX LOUES uniquement pour l’usage mentionné au TITRE II – CONDITIONS PARTICULIERES à l’exclusion de tout autre usage et activité additionnels ou de substitution, fussent-ils connexes ou complémentaires. Le PRENEUR s’engage en outre à utiliser les LOCAUX LOUES paisiblement, conformément aux articles 1728 et 1729 du Code civil, à l’exclusion notamment de toute vente au public, de tout entreposage et stockage, sauf si cet usage est mentionné au TITRE II – CONDITIONS PARTICULIERES, de toutes opérations de production industrielle, artisanale et de tout usage aux fins d’habitation.
Le PRENEUR reconnaît que les LOCAUX LOUES sont conformes à toutes les normes applicables pour les locaux et l’activité autorisée visée au TITRE II – CONDITIONS PARTICULIERES
Le PRENEUR ne pourra modifier, même partiellement ou momentanément, cette destination, ni changer la nature de l’activité exploitée dans les LOCAUX LOUES.
Le PRENEUR devra se conformer aux dispositions légales, réglementaires et aux autorisations administratives liées aux activités exercées par lui, de manière à ce que le BAILLEUR ne soit jamais inquiété à ce titre et soit garanti de toutes les conséquences qui pourraient en résulter et ce, même en cas de travaux dûment autorisés par ce dernier.
En particulier, le PRENEUR fera son affaire personnelle de l’obtention et du maintien en vigueur de toutes licences, autorisations et tous permis requis par les dispositions légales, réglementaires et les autorisations administratives en vigueur ou à venir, et du paiement de toutes sommes, contributions, impôts, redevances, taxes et autres droits afférents aux activités exercées dans les LOCAUX LOUES, aux aménagements effectués par le PRENEUR, et à leur utilisation notamment au titre de la réglementation relative au Droit du Travail, à l'hygiène, à la sécurité et aux bureaux. Il devra en justifier à toute réquisition du BAILLEUR.
De convention expresse, il est rappelé que pour le cas où l’exercice de l’activité du PRENEUR et /ou les travaux qu’il réaliserait, serai(en)t soumis à déclaration auprès de l’administration et/ou nécessiterai(en)t l’obtention d’autorisations administratives, notamment au regard des réglementations applicables :
• aux établissements recevant du public (ERP),
• aux immeubles de grande hauteur (IGH) et/ou aux installations classées pour la protection de l’environnement (ICPE) ou en matière d’hygiène, de santé ou de sécurité, de voirie, de salubrité ou de protection de l’environnement,
• et en matière d’accessibilité aux personnes handicapées,
le PRENEUR devra en faire son affaire personnelle, sans recours contre le BAILLEUR de manière qu’il ne soit pas recherché à ce sujet, lesdits travaux étant en tout état de cause soumis aux dispositions de l’article 7.2 du présent Titre ci-après.
Translation - English ARTICLE 5 – INTENDED USE
The TENANT must use the LEASED PREMISES solely for the use mentioned in PART II – SPECIAL CONDITIONS to the exclusion of any other additional or substitute use and activity, even if they are closely related or complementary. The TENANT also agrees to use the LEASED PREMISES peacefully, in accordance with articles 1728 and 1729 of the French Civil Code, to the exclusion, in particular, of any sale to the public, any warehousing and storage, unless this use is mentioned in PART II – SPECIAL CONDITIONS, all industrial or artisanal production operations and any use for habitation purposes.
The TENANT recognizes that the LEASED PREMISES comply with all the standards applicable for the premises and the authorized activity mentioned in PART II – SPECIAL CONDITIONS.
The TENANT may not modify this intended use, even partially or temporarily, or change the nature of the business conducted in the LEASED PREMISES.
The TENANT must comply with the legal and regulatory provisions and with the administrative authorizations connected with the activities conducted by it, so that no claims are ever made against the LANDLORD in this regard and the LANDLORD is indemnified and held harmless for all consequences that might result, even in case of work duly authorized by the LANDLORD.
In particular, the TENANT will see personally to obtaining and maintaining in force all licenses, authorizations and all permits required by the legal and regulatory provisions and the administrative authorizations in force now or in the future, and to the payment of all sums, assessments, taxes, fees, levies and other charges pertaining to the activities carried out in the LEASED PREMISES, to the improvements made by the TENANT, and to their use, particularly pursuant to the regulations relating to the Labor Law, to health, safety and to offices. It must provide proof of this whenever the LANDLORD so requests.
By express agreement, it is recalled that if the conduct of the TENANT’s business and/or the work that it carries out is subject to declaration to the authorities and/or necessitates obtaining administrative authorizations, particularly in light of the regulations applicable:
• to establishments open to the public (ERP),
• to high-rise buildings (IGH) and/or facilities classified for environmental protection (ICPE) or with regard to hygiene, health or safety, garbage collection, salubriousness or environmental protection,
• and with regard to accessibility for persons with disabilities,
the TENANT must see to this personally, without recourse against the LANDLORD, so that no action is ever taken against the LANDLORD in this regard, since, in any case, this work is subject to the provisions of article 7.2 of this Part !.
