  -> You're quite right. I guessed it was a civil and not crim. case.
agree  Filip Gadiuta: ECHR/CEDO (http://echr.coe.int) Constantinescu v. Romania: "lodge an application to have the judgment set aside". Used to translate the infamous "recurs in anulare", but I think it works here too.
