  -> Interesting. I'm no expert on french legal procedures. I was attempting to find a close equivalent in English and American law to the way the term is used in context. There may not be an exact equivalent to this procedure in English.

Cette procédure qui peut avoir lieu devant le tribunal de grande instance, ou le conseil des Prud’hommes (en fonction de la nature de la demande), ne permet pas au juge saisi de trancher l’affaire sur le fond du litige.

Plus concrètement, la procédure de référé peut être utilisée, par exemple pour faire cesser des travaux compromettant la solidité d’un bâtiment ou, à l’inverse, pour ordonner des réparations indispensables ; pour faire nommer un expert chargé d’examiner des malfaçons ; pour saisir un journal ou un livre en cas d’atteinte à la vie privée.

Dans le cas d’un référé, le recours à un avocat n’est pas obligatoire, mais vous devez assigner votre adversaire à une audience du Tribunal compétent par l’intermédiaire d’un huissier.

Attention : la décision prise en référé est immédiatement exécutoire, mais elle n’est que provisoire. Elle peut, en ce sens, faire l’objet d’une voie de recours (tel que l’appel par exemple), et les juges examineront plus tard le fond de l’affaire ne seront pas engagés par elle.

Just to point out the difference between the procedure and the aim of the applicaiton under the emergency procedure. The term you are seeking is for the bit of paper, the summons, which results from the procedure being applied.

This is an application made to a court using an emergency procedure in order to have a summons issued compelling someone to appear to as a matter of emergency. The statutory authority for this provision is to be found in the New Code of Civil Procedure, art. 485, §2.
It is a rather special provision and falls under the heading of “ordonnances de référé”, what in English law would be described as an “injunctions”. The “assignation d’heure à heure” are obtained using an emergency procedure similar to the English “interlocutory injunction.”

The GDT describes an “ordonnance de référé” as an “injunction order in chambers delivered by the juge des référés”.
The aim behind the order being sought is to summons a person to appear as a matter of urgency.
The “juge des référés” is the description applied to a judge who makes an emergency ruling. His decision is temporary but immediately applicable. (Cf. 1 below)
From the procedural point of view, a close English parallel is to be found in the “interlocutory injunction”, which shares the specific characteristics of being temporary and issued in an emergency.

Note that any hearing prior to the main hearing in which the case is actually judged and decided upon is said to be “interlocutory” (see www.xfer.com for the Oxford English Law Dic and www.law.com for US definitions). Again this is procedural.

Note that in such circumstances, where UK English uses “application”, US uses “petition”.
